TERMS AND CONDITIONS OF BOOKING WITH INDIAN OCEAN ENTERPRISES, INC..

Reservations, prices and payment: A deposit as indicated in the Registration Form is required at time of booking to request the reservations. Our Customized Tour requires a non refundable design fee of $100.00 to plan your itinerary and prepare a proposal and is included in the Deposit you have paid. Once reservations are confirmed, the final invoice is sent which will include details on the additional deposits required to hold reservations. The balance of payment is due 60 days prior to departure (90 days in case of the Peak Season). Prices are based on tariffs and exchange rates in effect at time of printing and are subject to change without notice. An administrative fee of $75.00 may be charged for bookings received within 30 days of the departure date. Any change to the reservations are subject to a $50.00 fee per person/ per change.

Please note: some of our local operators have payment schedules that differ from the above. Should they differ you will be advised at time of booking. Indian Ocean Enterprises, Inc. (IOE) will accept check, Mastercard Visa and American Express credit card payment for the design fee or deposit and no credit cards are accepted within 30 days of departure.

Insurance: IOE strongly recommends purchasing insurance for trip cancellation, injury, illness and loss of effects.

Cancellation of land tour: Cancellations must be received in writing. Cancellations received by IOE are subject to the following penalties:

Peak Season - Dec 20/Jan 08 -
      Upto 90 days prior to travel = $100
      Between 90 and 60 days prior to travel = forfeiture of deposit
      Between 60 and 45 days prior to travel = a penalty of 50% of price paid
      Less than 45 days prior to travel = a penalty of 100% of price paid

Off Peak Season - balance of year -
      Upto 60 days prior to travel = $100
      Between 60 and 45 days prior to travel = forfeiture of deposit
      Between 45 and 30 days prior to travel = a penalty of 25% of total price paid
      Less than 30 days prior to travel = a penalty of 100% of price paid

Please note: some of our local operators have cancellation fees that differ from the above. Should they differ you will be advised at time of booking and the higher fees will prevail.

Cancellation of air transportation: The cancellation fees for air transportation varies per carrier and applicable fares. The cancellation fees are in effect only after ticketing.

Documentation and health requirements: A passport valid for at least six months from your departure date is required for U.S. citizens with at least 2 blank pages per country to be visited. It is the responsibility of each traveler to adhere to the Health and Visa requirements of each country to be visited. IOE is NOT responsible for any lapse on this issue.

The land price includes: All necessary hotel taxes and service charges as required by the itinerary, accommodation, meals and excursions as indicated. Quoted tour prices also include planning, handling and operational charges, and are based on current rates of exchange, tariffs and taxes as of invoiced date.

The land price does not include: Airport departure taxes where levied, passport and visa fees, cost of personal trip cancellation and baggage insurance, transportation of excess baggage, all items of a personal nature such as laundry, alcoholic and soft drinks, bottled water, beverages, such as tea or coffee, optional excursions or deviations from scheduled tour, meals not shown and gratuities for the driver/guide, porters etc..

Price increases: IOE reserves the right to increase tour prices to cover statutory increases beyond our control (such as fuel surcharges, Government levy's) tariffs and taxes, and to reflect fluctuations in foreign exchange markets.

Rates: Rates as published may not necessarily correspond to published rates of the respective establishments and/or services. IOE reserves the right to include a reasonable mark-up for research, development, planning, handling and operations.

Claims and Refunds: Refunds are not made for any missed services, except for verifiable extenuating circumstances. For verifiable claims to be considered, they must be received in writing within 30 days of the termination of the program and be accompanied by supporting documentation and/or a statement from the Operating Company verifying the claim. Any adjustment considered will be based on the actual price of the services involved and not on a per diem basis. Adjustments will not be made for unused sightseeing trips or meals. IOE will not accept any liability for any claims that are not received within 30 days of the termination of your travel program. All claims for days missed while traveling should be made in writing within 30 days of the termination of the program.

Limits on Indian Ocean Enterprises, Inc.. Responsibility: Indian Ocean Enterprises, Inc. (IOE), its employees, shareholders, officers, directors, successors, agents and assigns (collectively Indian Ocean Enterprises, Inc.) , does not own or operate any entity which is to or does provide goods or services for your trip. It purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result IOE is not liable for any negligent or willful act of any such person or entity or of any third person.

In addition and without limitation, IOE is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

There are certain inherent risks in adventure travel of the type involved here. These include, but are not limited to, risks of white water rafting, kayaking and rafting (for example dangers of rapidly moving water, rocks and other submerged objects, hypothermia, etc), horseback riding, (for example, unpredictable behavior by the horses, being spooked, etc) hiking, walking safaris, and in all trips dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Passenger assumes all such risks with regard to these possibilities.

Travel Advisories/Warnings: It is the responsibility of The Traveler to become informed about the most current travel advisories and warnings by referring to the U. S. State Department's travel website at www.travel.state.gov/ or by phone at 1-888-407- 4747. In the event of an active State Department Travel Warning against travel to the specific destination location(s) of the trip, should The Traveler still choose to travel, notwithstanding any travel advisory or warning, The Traveler assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.

Arbitration Agreement: Any controversy or claim arising out of or relating in any way to these Terms and Conditions, to the Responsibility Clause, to any information printed by IOE or any information relating in any way to the trip, or to the trip itself, shall be settled solely and exclusively by binding arbitration in New Jersey, USA, in accordance with the rules of the American Arbitration Association then existent.

Travelers Representations: The Traveler represents that neither he nor she nor anyone traveling with him or her has any physical or other condition or disability that could create a hazard to himself or herself or other members of the tour. IOE reserves the right to decline to accept anyone on a trip. Our local suppliers reserve the right to remove from the trip, at his or her sole expense, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise impact the enjoyment of other passengers on the trip.

Air Transportation: Airlines concerned are not to be held responsible for any act, omission or event during the time passengers are not on board their planes or conveyances. These programs may use the services of any IATA carrier. International air carriers are subject to international air conventions limiting their liability. The limitations of liability are contained on the reverse side of the airline ticket and form part of the terms and conditions of this package. The passage contract in use by these companies, when issued, shall constitute the sole contract between the companies and the purchaser of these travel programs and/or passage.
